Today With Terms of Service

1. Accepting These Terms

Once these Terms become effective, you accept them by creating an account, accessing, or using the Service. If you do not agree, do not use the Service.

These Terms supplement any mandatory rights you have under applicable law. They do not replace the terms that govern your Apple Account, the App Store, or another third-party service.

2. Eligibility

You must be at least 16 years old to create or use a Today With account and must meet any higher minimum age required in your jurisdiction. If you have not reached the age of legal majority where you live, you must have permission from a parent or legal guardian where local law requires it.

Today With is not directed to children under 16 and does not offer child accounts, parent accounts, family supervision, or a parental-consent workflow. The current Service does not independently verify every user's age.

3. Your Account

3.1 Account requirement

An account is required to use the Service. The current iOS app supports Sign in with Apple, Google Sign-In, and email verification codes. It does not offer password-based, guest, or anonymous access.

The first successful sign-in with a verified identity that is not already connected to an active Today With account may create a new account. You are responsible for maintaining control of the email, Apple, or Google account used to access Today With and for protecting your device and authentication information.

3.2 Connected sign-in methods

You may connect more than one supported sign-in method. You may remove an email address or disconnect Apple or Google only if at least one other valid sign-in method remains. Removing one sign-in method does not delete your Today With account.

An email, Apple, or Google identity already connected to another Today With account cannot be connected to your current account. A matching email address alone does not prove that two accounts belong to the same person, and Today With does not currently provide a general account-merging feature.

3.3 Account security

You must not share verification codes, session information, or provider credentials. Contact support@todaywith.app promptly if you believe that your account or device has been accessed without authorization.

You are responsible for your authorized use of the Service. Keep your account information reasonably accurate and use the in-app controls to update a verified email or connected sign-in method.

3.4 Signing out

Signing out ends the current Today With session on the device. It does not delete your account or app data and does not cancel an App Store subscription.

4. The Service

Today With is a meal-recording and general-wellness service. Depending on your access level and service availability, it may let you:

• record or skip meals;
• upload or capture meal photos;
• attach an optional place to a meal;
• view recent or extended meal history;
• receive AI-generated food descriptions, nutrition estimates, meal observations, and Day Summaries; and
• purchase or restore Today With Plus through the App Store.

Some features require network access, device permission, a supported iOS version, an available third-party provider, or an active subscription. Feature availability may vary by account, storefront, device, region, and service status.

5. Your Content

This section requires product and legal approval before publication.

As between you and Today With, you retain any rights you have in meal photos, locations, and other content you submit to the Service (“Your Content”).

You grant Today With a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, create technical image variants of, process, and display Your Content only as reasonably necessary to:

• provide, operate, secure, and troubleshoot the Service;
• perform the AI processing described in these Terms and the Privacy Policy;
• comply with your instructions, such as editing or deleting content; and
• comply with applicable law or protect legal rights and safety.

This license ends when Your Content is deleted from the Service, except to the extent a copy remains under a disclosed backup, security, dispute, or legal retention rule. The license does not authorize Today With to sell Your Content or use it for third-party advertising. Today With does not currently submit Your Content to Google as model-training feedback.

You represent that you have the rights and permissions needed to submit Your Content and allow the processing described above. Do not upload content that unlawfully infringes another person's privacy, intellectual-property, publicity, or other rights.

6. Acceptable Use

You must not use the Service to:

• violate applicable law or another person's rights;
• upload content you do not have the right to use;
• harass, threaten, exploit, or harm another person;
• attempt to gain unauthorized access to an account, system, credential, or non-public data;
• interfere with the Service, bypass access or subscription controls, probe for vulnerabilities without authorization, or distribute malicious code;
• misrepresent an identity, transaction, subscription owner, or account-deletion request;
• use automated means to scrape, overload, or abuse the Service except through an interface or permission Today With expressly provides; or
• reverse engineer or circumvent technical protections except to the extent applicable law expressly permits that activity.

We may investigate suspected misuse and take proportionate steps to protect users, providers, and the Service, subject to applicable law.

7. AI Features and Important Safety Limits

7.1 How AI is used

Today With currently uses Google Gemini through Google Cloud Vertex AI to analyze meal images and context and to generate Day Summaries. Meal-analysis inputs may include meal photos, meal type, locale, time zone, optional attached location text, and an internal meal identifier. Day Summary inputs contain structured meal states and AI-generated meal keywords.

7.2 Results are estimates

AI-generated food descriptions, energy values, macronutrient proportions, observations, and summaries are estimates. They may be incomplete, inaccurate, inconsistent, delayed, or unavailable. A photo may not show every ingredient, amount, drink, condiment, oil, sauce, preparation method, allergen, or source of contamination. Today With does not directly measure portion weight, ingredients, laboratory nutrition, or food safety.

No physician, registered dietitian, nutritionist, laboratory, or other professional routinely reviews an individual result before it is displayed.

7.3 General wellness only

Today With is provided for meal recording and general-wellness information. It is not a medical device, medical advice, diagnosis, treatment, emergency service, clinical decision-support system, or substitute for a qualified professional.

Do not rely on the Service:

• to diagnose or treat a disease, allergy, eating disorder, nutritional deficiency, or other medical condition;
• to determine whether food is allergen-free, uncontaminated, safe to eat, religiously compliant, or compatible with a prescribed diet;
• to calculate medication, insulin, supplement, or therapeutic nutrition dosage;
• as the sole basis for a medical, dietary, pregnancy, weight-management, or other health decision; or
• in an emergency or other time-sensitive situation.

Check the actual food, packaging, ingredient information, professional guidance, and applicable safety warnings. Contact a qualified professional about a health concern and contact your local emergency service in an emergency.

8. Today With Plus and App Store Subscriptions

8.1 Products and payment

Today With currently offers monthly and yearly auto-renewable Today With Plus subscriptions through Apple's In-App Purchase system. The product, price, currency, billing period, taxes, and any offer displayed by the App Store at the time of purchase control the transaction.

Apple processes payment using your Apple Account. Today With does not receive your payment-card number, Apple Account password, or Apple Pay credential.

8.2 Renewal and access

An auto-renewable subscription renews through Apple unless you cancel it or Apple reports another subscription outcome. Today With Plus access begins only after Apple-signed transaction information is verified and the Today With backend confirms that the subscription belongs to the current Today With account.

A pending, cancelled, unverified, or server-unconfirmed transaction does not activate Plus. A local StoreKit entitlement alone does not establish that the current Today With account owns the subscription.

8.3 Restore Purchases and ownership

The Paywall includes Restore Purchases. Restore asks Apple and Today With to synchronize and verify eligible purchases. It does not create a charge by itself, merge Today With accounts, or automatically transfer a subscription between accounts.

An Apple subscription chain can be linked to only one Today With account at a time. If it is linked to another active account, you may need to use that account. Certain subscriptions released after account deletion or eligible expired subscriptions may require a separate confirmation and a newly verified Apple purchase. These recovery flows do not restore data from a deleted account.

8.4 Cancellation, plan management, and refunds

Today With does not operate its own cancellation, billing-method, plan-management, or refund-decision system. Manage or cancel the subscription through Apple. Cancellation normally prevents a future renewal but does not delete your Today With account or app data. Plus access follows the subscription state subsequently confirmed by Apple and Today With.

Refund eligibility and approval are controlled by Apple. See Apple's subscription-management instructions and refund-request process.

8.5 Account deletion does not cancel a subscription

Deleting your Today With account does not cancel an App Store subscription, stop Apple billing, or request a refund. If you do not want the subscription to renew, cancel it through Apple before deleting your Today With account.

When an account is deleted, Today With releases the account's ownership of subscription records while retaining transaction, renewal, notification, amount, refund, and lifecycle facts as described in the Privacy Policy. A later account does not receive deleted meal or account data by claiming or purchasing a subscription.

9. Free Access and Feature Limits

The current Service provides a limited recent-history window and a limited number of meal-level Nutrition trial unlocks to Free accounts. Today With Plus provides additional access described in the app.

Feature descriptions do not guarantee that a particular feature, free allowance, or Plus benefit will remain unchanged forever. We may modify the Service for product, security, provider, legal, or operational reasons, subject to applicable law and any notice or remedy required for a paid subscription.

10. Ownership of the Service

Today With and its licensors retain their rights in the Service, including the app, software, interface, visual design, branding, documentation, and service-generated technology, excluding Your Content and third-party materials.

Subject to these Terms and applicable App Store rules, you may use the Service for your personal, non-commercial use. These Terms do not transfer ownership of the Service or grant a right to copy, distribute, sell, sublicense, publicly display, or create derivative works from the Service except where applicable law permits.

Your license to the iOS app is also subject to the applicable Apple Media Services terms and either Apple's Standard Licensed Application End User License Agreement or a valid custom EULA if one is provided through the App Store. Apple's app-license terms do not make Apple the operator of the Today With account, backend, AI, or meal-recording services.

11. Privacy

Our Privacy Policy explains how information is collected, used, disclosed, retained, and deleted in connection with the Service. By using the Service, you acknowledge that you have had an opportunity to review it.

12. Third-party Services

The Service depends on or links to services provided by Apple, Google, Amazon Web Services, and other providers described in the Privacy Policy. Third-party services may be unavailable, changed, or governed by separate terms and privacy notices. Today With does not control an external service merely because the Service interoperates with or links to it.

You must comply with the terms that apply to your Apple Account, App Store purchases, device permissions, and other third-party services you choose to use.

13. Service Availability and Changes

We aim to operate the Service reliably, but we do not guarantee uninterrupted, error-free, or permanent availability. Maintenance, provider failures, network conditions, device compatibility, security events, legal requirements, or other circumstances may delay, limit, or prevent access to a feature.

We may update, suspend, or discontinue a feature or the Service for legitimate product, security, legal, or operational reasons. For a paid service, we will provide any notice, continued access, refund, or other remedy required by applicable law or the controlling App Store terms.

14. Suspension and Termination

We may restrict or suspend access when reasonably necessary to protect the Service or another person, investigate suspected misuse, comply with law, or address a material violation of these Terms. Where appropriate and legally required, we will provide notice and an opportunity to address the issue.

You may stop using the Service or sign out at any time. Signing out does not delete your account. You may permanently delete your account through Settings → Delete Account after reauthentication.

After an account-deletion request is accepted, ordinary account access is blocked, active Today With sessions are revoked, and the deletion process is intended to complete no later than seven days after acceptance. The request cannot currently be cancelled, and deleted account or meal data cannot be restored. Records that must be retained for operational, security, accounting, tax, fraud-prevention, dispute, or legal reasons may remain as described in the Privacy Policy.

Sections that by their nature should continue after termination—including provisions concerning retained records, ownership, disclaimers, liability, disputes, and mandatory legal rights—will continue to the extent permitted by law.

15. Disclaimers

This section requires jurisdiction-specific legal review before publication.

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.” Today With does not warrant that the Service will always be available, secure, error-free, or suitable for every purpose, or that AI outputs will be accurate, complete, or reliable.

Nothing in these Terms excludes an express promise we make to you, a warranty or remedy provided by Apple for an App Store transaction, or a statutory consumer guarantee that cannot lawfully be excluded or limited.

16. Limitation of Liability

This section requires the legal operator, launch territories, and jurisdiction-specific legal review before publication.

To the maximum extent permitted by applicable law, Today With will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from the Service, including loss resulting from unavailable or inaccurate AI output, loss of data, interruption, or reliance on general-wellness information.

This limitation does not apply where liability cannot lawfully be excluded or limited, including any mandatory liability for fraud, intentional misconduct, gross negligence, personal injury, death, or statutory consumer rights to the extent applicable law provides.

No monetary liability cap is selected in this draft. A final clause must not be added until the operator and launch jurisdictions are known and legal review confirms that the clause is appropriate and enforceable.

17. Mandatory Rights and Disputes

Nothing in these Terms removes non-waivable consumer, privacy, subscription, minor, or other statutory rights available to you under applicable law.

If you have a concern, contact support@todaywith.app so we can try to resolve it. Contacting support is not mandatory arbitration, does not waive a legal right, and does not prevent you from using a court, regulator, or complaint process available under applicable law.

No governing law, exclusive venue, arbitration requirement, class-action waiver, jury-trial waiver, or mandatory informal-dispute procedure is selected in this draft. These Terms must not be published until the final clause is approved and added.

18. Changes to These Terms

We may update these Terms when the Service, subscriptions, providers, or legal requirements change. Before revised Terms become effective, we will update the Effective Date or Last Updated date and provide any notice or request for renewed agreement required by applicable law.

If you do not agree to revised Terms, you may stop using the Service and may delete your account. Ending use or deleting an account does not itself cancel an App Store subscription.
